1. General principles

  • JPXL Records respects the copyright, related rights, trademark rights and other rights of third parties, and requires the same from Users.
  • Copyright in a musical work (melody, lyrics, arrangement) and related rights in a sound recording (master recording) are separate, independently protected objects. Claims relating to each are handled separately.
  • A release against which a claim has been filed or in respect of which signs of infringement are identified may be suspended, taken down, or referred for additional legal review pending resolution of the dispute.

2. Filing a complaint

  • Complaints should be sent to JPXLRECORDS@GMAIL.COM with the subject line 'Copyright claim'.
  • A complaint must include: the claimant's name and contact details (full name, organisation, email); identification of the work (title, author, work ID, release ID, links); identification of the specific release or track alleged to infringe; a description of the infringement; and a statement of the claimant's authority (rights holder or authorised representative).
  • The authority statement must include wording to the effect of: 'I declare that the information in this complaint is accurate and that I am the rights holder or their authorised representative.'

3. Review

  • The Operator will review a complaint within 10 business days of receiving the complete set of information.
  • If clarification is needed, the Operator will request additional materials; in that case the review period runs from receipt of the claimant's response.
  • Following review the Operator may: take the release down; leave the release unchanged where the grounds for the complaint are insufficient; or notify the account holder of the complaint received.

4. User documentation

  • At the Operator's request, the User must provide documentation confirming rights to the Content: author agreements, licences, split sheets, sample clearances, master and artwork rights confirmations.
  • Documents must be provided within 5 business days of the request, unless the Operator specifies a different deadline.
  • Failure to provide documents within the deadline is grounds for suspension or rejection of the release without any financial penalty to the Operator.

5. Counter-notice

  • A User who considers a complaint unfounded may submit a counter-notice to JPXLRECORDS@GMAIL.COM within 10 business days of being notified of the complaint.
  • A counter-notice must include the grounds for the User's lawful use of the Content and, where applicable, supporting documentation.
  • The Operator will review the counter-notice within 10 business days and make a decision on the status of the release.
